In my experience, legal review is essential, but can be a bottleneck, delaying critical releases.  And, the legal department often complains about answering repetitive questions.  We solved this for a national energy-drink brand.

This national energy-drink brand competes in a retail category where promotional timing is pivotal.  It decides whether a campaign lands on shelf or misses its window of potential popularity. Their marketing team consistently produced campaigns that met brand standards and strategic goals, but ran into slowdowns at legal review. 

These legal reviews were very necessary, as advertising claims are regulated differently in each region where an ad runs, but they added days, sometimes weeks, to each launch depending on where the ad would run.

The VP of Marketing explained, "our campaigns were ready.  The question was always weither legal could get to them before the window closed."  Legal review had become the critical path and a major blocker for their entire marketing calendar. The team needed to add campaign speed without adding liability or headcount.

Our solution began with an Art-of-the-Possible session that mapped where legal review was consuming the most calendar time, to prioritize where to focus first.

Once that was complete, a system was developed where counsel reviews and certifies the chatbot as “safe to use” across the majority of the brand’s regions and use cases, encoding the legal team’s judgement, rather than replacing it. If a question has not been certified, it routes automatically to counsel to review manually.

Now, marketers can ask whether a claim, offer, or placement clears the rules in a given market and receive an immediate, pre-cleared answer. 

Marketing is faster and the Legal team can devote their time to the questions that require their intervention. The application also gives both departments an auditable record of what was asked, what was cleared, and where the rules generate the most friction. 

The chatbot has removed in-depth legal review from the critical path for the majority of the brand’s campaigns. Over 500 in-house counsel hours are pre-cleared by the assistant each year, an estimated $125,000 to $200,000 in returned legal capacity, and each campaign now reaches market five to ten days faster with no added headcount on either team.

Not only are both the marketing and legal teams pleased, but the recovered velocity also supports a significant number of additional campaigns per year, with each incremental national promotion conservatively worth $50,000 or more in retail contribution.

The certification model also protects the downside: a single pulled campaign can cost $50,000 to $250,000 in fines, agency rework, and missed shelf timing, and certified guidance takes that worst case off the table.
